Right of Withdrawal
In accordance with Article 52 of Legislative Decree September 6, 2005 No. 206 (the "Consumer Code"), you have the right to withdraw from the contract signed with Florilege Srl (the "Seller" or "Florilège") without penalty and without having to provide any reason, within 14 days from the day you received the products purchased on florilege.it.
In accordance with Article 54 of the Consumer Code, you may exercise your right of withdrawal using, at your option, one of the following methods:
(a) Sending by email to the Seller, stating that you wish to withdraw from the contract of sale; in this case, the Seller will send you confirmation by email that the declaration of withdrawal has been received;
b) sending by mail to the Seller Registered A/R, conforming to the model form pursuant to Article 49, paragraph 4, of the Consumer Code, to be completed in full;
c) sending by mail to the Seller of other explicit statement of your decision to withdraw from the contract.
In cases b) and c), your statement must be sent to the attention of Customer Service at the offices of Florilege Srl, Via Privata Cesare Battisti 2, 20122 Milan. It is understood that, in such cases, the burden of proving the correct and timely exercise of the right of withdrawal will be on you.
In accordance with Article 57 of the Consumer Code, once you have exercised your right to withdraw from the contract, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you informed Seller of your decision to withdraw from the contract.
In accordance with Article 59 of the Consumer Code, the right of withdrawal is excluded if you have purchased custom-made or personalized products or sealed goods that are not suitable for return for hygienic or health protection reasons and have been opened after delivery.
1. Conditions for the exercise of the right of withdrawal in accordance with Article 52 of the Consumer Code.
The right of withdrawal shall be deemed to be properly exercised if the following conditions are fully met:
a. the right of withdrawal must be properly exercised within fourteen (14) days of receipt of the products by following one of the methods indicated above;
b. the products must not have been used, worn, washed and, in any case, must comply with the requirements set forth in Article 3, below, on the conformity checks of returned products;
c. the identification tag, Packaging complete with Box and/or Envelope must accompany the products as they are an integral part of the goods (see in this regard art. 5, below);
d. products must be returned in their original packaging (if you want to return a kit, you must return all the items that make it up);
e. the returned products must be delivered to the shipper within fourteen (14) days starting from when you have notified the Seller of your decision to withdraw from the contract;
f. the products must not be damaged.
If you have complied with all the required conditions, the Seller, in accordance with Article 56 of the Consumer Code, will refund you in full the price of the products purchased, with you being responsible only for the cost of the return, i.e., the cost of returning the purchased products to the Seller, unless the Seller has expressly exempted you from such costs at the time of purchase and on the further condition that you use the forwarding agent and shipping methods suggested by the Seller in paragraph 2 below.
2. Methods of returning products to the Seller
The Seller suggests that you use the DHL shipper (http://www.dhl.com/) to return purchased products. If you decide to use DHL for the shipment and make use of the pre-printed adhesive label - bearing the return address - included in the package containing the purchased products, you will not have to pay the return costs yourself. In fact, the Vendor will pay, on your behalf, the courier, withholding from your refund a lump sum equal to the cost previously incurred in delivering the purchased products to your home. Contact DHL to arrange for pickup. This shipping method also allows you to verify, at all times, where each package is located, releasing you from any liability in the event of loss or damage to the products during transit.
On the other hand, in the event that you decide to use a shipper other than DHL, you will have to pay the return shipping costs yourself and you will remain responsible in case of loss or damage of the products during transport. It is understood that, in this case will also be refunded an amount equivalent to the cost of standard shipping of the products purchased, while, in accordance with art. 56, paragraph 2, of the Consumer Code, will not be refunded any additional costs incurred by you for having chosen a type of shipping and delivery different and / or faster than the standard one.
3. Conformity checks of returned products
You will be contacted by the "Customer Service" if your return can not be accepted because it does not comply with the conditions referred to in letters a) and e) of paragraph 1 above or in the hypothesis referred to in Article 59 of the Consumer Code and you can choose to get back the products purchased at your own expense. Should you refuse this shipment, the Seller reserves the right to retain the products and the amount corresponding to the purchase price of the products.
All products must be returned new and unused, in perfect condition, with all protective materials and identification tags and stickers attached to the products (if any), as well as their packaging, accessories and documentation. If the product shows signs of use or has been used or altered from its original condition in any way, the Seller reserves the right not to accept the return or, alternatively, to reduce the refund or exchange amount accordingly.
For example, the Seller may make a curtailment of the refund under the following circumstances:
- the products have been used, worn, damaged or washed;
- the original packaging that is an integral part of the product (e.g. Box, Warranty, Envelope) was not returned.
You will be contacted if the Seller decides to curtail the refund for this reason. In this case, you may choose (as an alternative to curtailment of the refund) to have the purchased products back at your expense. In the latter case, should you refuse the shipment, the Seller will be entitled to retain the products and the amount indicated for the curtailment of the refund due to the decrease in value of the returned products.
The Seller assumes no responsibility for products returned in error or for items forgotten in packages or returned products.
4. Timing and method of refund
After the Seller has received your return and checked that all requirements have been met, you will receive an e-mail confirming acceptance of the return and Florilège will proceed with a full refund, or, if it is found that there is a decrease in the value of the returned products, you will receive an e-mail informing you of the amount deducted by way of curtailment of the refund and Florilège will proceed with the refund of the amount due. Whichever of the available methods of payment you used, the refund is activated by the Seller as soon as possible, and in any case within fourteen (14) days from the date on which it became aware of the exercise of your right of withdrawal, once it has verified that the withdrawal has taken place in compliance with the conditions set out above and the product(s) returned to our Offices.
The actual time for re-crediting or returning the amounts you paid for the purchase of the products depends on the method of payment used:
- credit/debit card purchase: the refund time depends on the credit/debit card company. Please note that the value date of the chargeback is the same as the debit, so you will not suffer any loss in terms of bank interest;
- cash on delivery (if available): reimbursement is made to the bank account you indicate, so the time of reimbursement depends on the correctness of the data you enter; normally the re-credit is made within fourteen (14) days.
In the case of a gift, the refund of amounts will be made to the person who made the payment.
If you so desire, as an alternative to a refund to your credit/debit card or bank account that you indicate at the time you exercise your Right of Withdrawal, you may elect to receive a Voucher. You may use your credit for purchases on Florilege.co.uk in the manner set forth in Article 10 of the Conditions of Sale.
5. Defective or non-conforming products
Without prejudice to the application of the mandatory rules for the protection of consumers, you may return a product because it is defective or does not conform to what you ordered, by informing the Seller, within fourteen (14) days from the day you received the products purchased on florilege.it, by e-mail to HELLO@florilege.it; if the defect becomes apparent after fourteen (14) days, contact Customer Service for more information.

Florilège will check the products that you have returned because they are affected by defects or do not conform to what you ordered and will proceed with a full refund, including shipping costs and the costs you incurred to return the products to Florilège
In the event that Florilège does not detect any defect or lack of conformity in the returned products, you will be informed that your return cannot be accepted and you will have the choice of whether to have the purchased products back. Should you refuse the shipment, Florilège will have the right to retain the products and the amount corresponding to the purchase price of the products, as well as reserve the right to claim the costs incurred.
6. Consumer Code.
These Conditions for the exercise of the right of withdrawal, forming an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.
